The High Court in Lilongwe has granted Vice President Michael Usi permission to pursue judicial review proceedings against a notice issued by the Anti-Corruption Bureau (ACB), which compelled him to answer questions and produce documents related to corruption allegations.
Justice Redson Kapindu ruled that while the Acting Director of the ACB has the authority to issue such notices, the order requiring Usi to submit documents within 24 hours was unreasonable, particularly during the ongoing presidential campaign.
Usi, who is also president of the Odya Zake Alibe Mlandu party and a presidential candidate in the September 16 elections, argued that the notice infringed on his freedom of expression and was designed to frustrate his campaign efforts.
He told the court that the statements under scrutiny were made during political rallies as part of his campaign message on endemic corruption.
In his ruling, Justice Kapindu observed that the Vice President holds significant constitutional responsibilities but also enjoys protections under the law to campaign freely.
