MALAWI: High Court Freezes Judicial Service Commission’s Cases Against Chief Justice Koome, Supreme Court Judges Amid Legal Dispute

The High Court has extended an order stopping the Judicial Service Commission (JSC) from proceeding with cases involving Chief Justice Martha Koome and Supreme Court judges Isaac Lenaola, Smokin Wanjala, William Ouko, and Njoki Ndung’u.
Justice Lawrence Mugambi directed all parties to submit their responses regarding a request to form a bench to hear the matter.
The decision has sparked criticism from lawyers Nelson Havi and Ahmednasir Abdullahi, who questioned why the empanelment issue is being prioritized, considering the Chief Justice is directly affected.
Lawyer Ochieng Oduol urged respect for the court’s ruling, while Nelson Havi vowed to challenge the decision, arguing that CJ Koome should not have a role in selecting judges for a case in which she has a personal interest.
Havi has filed a preliminary objection, asserting that the High Court lacks jurisdiction and that the JSC should be allowed to handle the matter independently.
Citing internet connectivity concerns, the court ruled that proceedings would take place in open court. Additional applications have been submitted, including one seeking to add more parties to the case and another requesting Justice Lenaola’s testimony.
The case is set for mention on March 28, with lawyer Ahmednasir Abdullahi calling for an expedited hearing.
