LAW LOUNGE: Marriage Under The Act in Nigeria, Things You Need To Know
By Barr. Balami Emmanuel Paul and Munyal Markus Manunyi
Marriage in Nigeria is defined as a union between one man and one woman, recognized legally under the Act or through customary and Islamic practices. Church weddings are celebrations but lack legal recognition without proper documentation. A valid marriage certificate is crucial for divorce and legal rights. Recent changes show some churches are gaining legal recognition for their certificates, reflecting evolving legal perspectives on marriage.
Marriage under the Act is defined as a union of one man and one woman. Circumstances such as one of the parties being previously married or marrying someone already married under any form of act can invalidate a marriage under the Act.
Customary marriages vary widely across Nigeria, with numerous customs recognized under the law.
Before marriage, you must publish your intention for 21 days in a national daily to allow for any objections.
Legal marriage can be more financially advantageous and less burdensome than traditional marriages, which often come with extensive lists of requirements.
